Original Text (Ottoman Turkish)

Divriklidir. "Hamisoğlu" demekle meşhûrdur. 1133 senesi cemâziyelâhirinin dokuzuncu günü Amasya mutasarrıfı olup Şâhinoğlu Osmân Ağa'yı mütesellimlikde ibkâ ederek harbe me'mûren şarka gitdi.

1134 senesi muharrem gurresinde a'yân Hoca Paşazâde Hacı İbrâhim Bey baş a'yân ve Murâd Beyzâde Hacı Mehmed Ağa Amasya mütesellimi olup sâbık mutasarrıf zamânında yapılan yolsuzlukların tedkîkâtına başlandı. Bu esnâda Amasya a'yânından câmi' sâhibi Çorakçıoğlu Halîl Ağa hizmet ve istikâmetine binâ'en mîr-i mîrânlıkla Kocaili sancağı mutasarrıfı oldu.

Rebî'ulevvelde Ömer Paşazâde Osmân, Rahtuvân Paşazâde Hacı İbrâhim, evkâf-ı sultâniyye mütevellîsi Yeğen Hacı Alî Beyler'le Ortaköylü Hacı Vahâb, Giritlioğlu Hacı Ebûbekir Efendiler'in, Sancıoğulları Ahmed ve Hasan ve Kırık Hasan Ağalar'ın muhâsebelerini rü'yet ve haklarındaki şikâyetleri tahkîk etmeğe yine müftü Âkif Mustafâ Efendi me'mûr oldu. [30]

Çünkü Torumtay'ın son evlâd-ı zükûrundan Dursun Bey'in oğlu olmadığından tevliyet iki kızlarına tevcîh edilmişdi.

Receb evâ'ilinde evkâf-ı sultâniyye mütevellîsi mîrlivâ Yeğen Alî Bey'in vefâtıyla emvâl-i müdhişesi müsâdere edilmek üzere zabt ve temhîr edildiğinden oğulları Osmân, İbrâhim Beyler İstanbul'a gitdiler.

In Modern English

He was from Divriği. He is known as "Hamisoğlu". On the ninth day of Cemâziyelâhir 1133 [April 1721] he became governor (mutasarrıf) of Amasya; leaving Şâhinoğlu Osman Ağa in the mütesellimlik, he went east on assignment to the war. The governor of Sivas was also from Divriği.

At this time Hocazâde Hacı Hâfız Halil Efendi, preacher of the Sultan Bayezid Mosque and one of the great righteous men and scholars, died; Hâfız Mustafa Efendi became preacher. This Halil Efendi was the father of Vizier Abdülganî Pasha, of Hacı Emîr İmam Abdüllatif Efendi, the owner of a library, and of the statesman Mehmed Emin Efendi. In Zilhicce Iydîzâde Abdurrahim Efendi became nakîb kaymakamı.

Çorakçıoğlu el-Hâc Halil Ağa was charged with taking over what Ahi Mehmed Pasha, who had been dismissed and killed, and his brother Bostancıbaşı Mehmed Ağa had left behind; he went to Sivas and set out for Istanbul to deliver the proceeds of the confiscated estate.

On the first day of Muharrem 1134 [October 1721] Hoca Paşazâde Hacı İbrahim Bey, one of the ayan, became chief ayan and Murad Beyzâde Hacı Mehmed Ağa became mütesellim of Amasya, and an examination of the irregularities committed in the time of the former governor began. At this time Çorakçıoğlu Halil Ağa, one of the ayan of Amasya and owner of the mosque bearing his name, became governor of the sanjak of Kocaeli with the rank of beylerbeyi because of his services and honesty.

In Rebîülevvel, Mufti Âkif Mustafa Efendi was again charged with examining the accounts of Ömer Paşazâde Osman, Rahtuvan Paşazâde Hacı İbrahim and Yeğen Hacı Ali Beys, administrator of the sultan's waqfs, and of Ortaköylü Hacı Vahab and Giritlioğlu Hacı Ebubekir Efendis, of the Sancıoğlus Ahmed and Hasan and of Kırık Hasan Ağa, and with investigating the complaints against them.

On the first day of Cemâziyelevvel [February 1722] Bahâeddin Mehmed Efendi came as kadı of Amasya. At this time Gürcüzâde Hacı İsmail Bey, one of the ayan, and Hasan Ağa, his maternal aunt's son, filed a suit against the administrators of the Torumtay waqf over the administratorship of the waqf. The kadı fell into considerable difficulty because of this suit.

For since Dursun Bey, the last male child of Torumtay, had no son, the administratorship had been given to his two daughters. Their husbands were the scholar Mustafa Efendi and Gürcüzâde Mustafa Bey. After the daughters' deaths the administratorship was given first to Mustafa Efendizâde Şeyh Mehmed Efendi, then to Mustafa Beyzâde Mehmed Bey, and when they too died, solely to Şeyh Mehmed Efendizâde Hacı Abdurrahman Efendi; when Hacı Abdurrahman Efendi also died last year, it had passed to his brothers Hâfız Hasan and İbrahim Efendis.

The crux of the suit was whether the parties were to be counted as of the first generation or the second. Hacı İsmail Bey and Hasan Ağa claimed they were the first generation; the administrators claimed that those two were the second and they themselves the first. Hacı İsmail Bey, son of Gürcüzâde Mehmed Bey, and Hasan Ağa strove to prove their suit; the others too argued the opposite and tried to prove it.

At the beginning of Receb, since on the death of Yeğen Ali Bey, sanjak governor and administrator of the sultan's waqfs, his incredible wealth was seized and sealed for confiscation, his sons Osman and İbrahim Beys went to Istanbul. At this time Hacı Veli Ağa of Amasya, the former kethüda of the gatekeepers, came from Istanbul as administrator of the sultan's waqfs.

In Şaban the Gürcüzâde suit was concluded with great difficulty: Hacı İsmail Bey and his friend Hasan Ağa became joint administrators of the Torumtay waqf, while the two brothers were left deprived. Rather bitter words were spoken against the kadı. It was said that Mufti Âkif Efendi, who was in charge of the investigation, had also taken sides, and complaints against both him and Alaybeyi Kuloğlu Mustafa Bey followed one another, and the disputes among the ayan became sharp. At this time, since Governor Ebubekir Pasha became beylerbeyi, the sanjak of Amasya together with the governorship of Konya was given to Vizier Mehmed Pasha, governor of Çıldır.

Hamisoğlu Ebubekir Pasha

Ebubekir Pasha, whom Hüsameddin introduces as "of Divriği, Hamisoğlu", is a beylerbeyi whose name is also mentioned in the Iranian wars after he left the governorship of Amasya. In Ali Açıkel's study examining the contributions of the province of Sivas to the Iranian campaigns of the reign of Ahmed III, it is seen that in early 1727 Ebubekir Pasha was brought to the governorship of Sivas and that in the archival documents he is called "Sivas Beylerbeyi Hamisoğlu Bekir" or "Hamiszâde Ebubekir Pasha". By an order of January 1727, with 1,000 men of the kapı halkı (household troops) and 1,000 select cavalry levends, he was placed under the command of Vizier Ahmed Pasha, seraskier of the Hamadan and Isfahan front, and was required to be ready at Kermanshah by 22 May 1727. But since the pasha did not arrive in time, a new order was sent to him in June 1727. That the nisba given by Hüsameddin and the nickname in the archival documents are the same strongly suggests that the two records speak of the same person; however, Ebubekir Pasha's posts after Amasya could not be traced in detail in the sources.

At the beginning of the entry it is said that Ebubekir Pasha went east "assigned to the war". In May 1722 a decision had been made for a campaign against the Safavid State. This decision rested on reasons such as compensating for territories lost in the west with victories in the east, taking advantage of the turmoil in Iran to seize cities such as Ganja and Tabriz, centers of the raw-silk trade, preventing Russia from descending to the Caspian shores, and preventing an Afghan state from being established on Iranian lands. In this period the province of Sivas consisted of seven sanjaks: the center, Amasya, Arapkir, Bozok, Canik, Çorum and Divriği. The sanjak of Amasya was also among the sanjaks that contributed to these wars by sending soldiers, camels, provisions and money for the campaign.

The Torumtay Waqf Lawsuit

The longest part of the entry is devoted to the lawsuit filed over the administratorship of the Torumtay waqf. The founder of the waqf, Seyfeddin Torumtay, was an emir who was appointed governor of Amasya in the time of the Seljuk Sultan Gıyâseddin Keyhusrev II. The mosque he had built, called "Gökmedrese" in his waqf deed, was used both as a mosque and as a madrasa. Because the inscription of the building was torn from its place, the date of construction is not known with certainty; but since the waqf deed arranged by Seyfeddin Torumtay bears the date 665 (1266–67), the construction is accepted to have been finished by that year at the latest. Torumtay's own tomb is a cut-stone building dated 677 (1278–79), separated from the mosque by a street. It is stated that, besides Torumtay, the graves of his children and grandchildren are in the tomb; as for who lies in the second tomb, adjoining the Gökmedrese Mosque and decorated with glazed brick and tile, it is not known.

The suit that Hüsameddin relates shows that a Seljuk waqf, four and a half centuries after its founding, was still administered by the founder's descendants and that its income could become the subject of a family quarrel. In family waqfs (evlatlık vakıflar) the administratorship passed from generation to generation according to the order set in the waqf deed. The "batn-ı evvel" and "batn-ı sânî" dispute likewise concerned how this order was to be interpreted: whichever of the parties was counted one generation closer to the founder, the administratorship fell to him. The male line ending with Dursun Bey, and the administratorship passing to his daughters and then to the line of the daughters' husbands, had set two separate branches of the family, namely the grandchildren of Mustafa Efendi and of Gürcüzâde Mustafa Bey, against each other. That in the end the Gürcüzâdes won and that "bitter words" were spoken against the kadı shows that the decision was received controversially in Amasya.

The Confiscation of Yeğen Ali Bey's Property

The seizure of the property of Yeğen Ali Bey, administrator of the sultan's waqfs, after his death should be considered together with the confiscation of the estates of Ahi Mehmed Pasha and Bostancıbaşı Mehmed Ağa, told in the same entry. In the Ottoman State the wealth of persons in state service could be confiscated on behalf of the treasury at their death or dismissal. It is known from archival documents that after the killing of Nalband Mehmed Pasha his mansion, his shops and other property that came to light through his wife's denunciation were seized, sold, and the proceeds transferred to the treasury. According to Hüsameddin, one of those responsible for this work in Sivas was Çorakçıoğlu Halil Ağa of Amasya; his reward for carrying out the task successfully was the sanjak of Kocaeli with the rank of beylerbeyi.

Hocazâde Halil Efendi and His Family

"Hacı Emîr İmam Abdüllatif, the owner of a library", counted among the sons of Hocazâde Halil Efendi, preacher of the Sultan Bayezid Mosque, is Emîr Hacı Abdüllatif Çelebi, whose name appears often in the earlier entries of the bakiyye. In the previous section of the fourth volume Hüsameddin records that upon the death of Hocazâde Abdüllatif Efendi, sheikh of the imaret, the sheikhdom of the imaret was given to his elder son Hâfız Halil Efendi, and that his younger son Seyyid Abdüllatif Çelebi was later called "Emîr Hacı". The library bearing the name of this Abdüllatif Efendi stood east of the Sultan Bayezid Mosque. A nice detail showing the library's place in the intellectual life of Amasya concerns Hüsameddin himself: the historian, born in Amasya in 1869, in his rüştiye (secondary school) years found the opportunity to examine many books in the Abdüllatif Efendi Library and began to gather his first information on the history of Amasya at that time. Thus the library founded by Emîr Hacı, named in this entry, became, two centuries later, the first school of the historian who would write his story.
